An investigation of the efficacy of public procurement legislation and procurement performance in public institutions in Tanzania

Abstract
This study aimed at identifying determinants within the procurement processing cycle in selected public institutions; and the influence of such determinants to the procurement processing cycle time, and if there exist a strong relationship between Public Procurement Legislation and/or public institution setup. The study was conducted in four (4) selected public institutions namely; Ministry of Agriculture Food Security and Cooperatives, Tanzania Electric Supply Company Limited, Tanzania Airport Authority and Medical Stores Department, all being public institutions based in Dar es Salaam whereby data were collected from a sample size of 140 respondents. Random sampling was employed to select the respondents from public institutions. Data were collected by interviewing respondents using questionnaires as the main tool, comprised of closed and open ended questions. Data analysis was done by using both quantitative and qualitative methods. Results from hypothesis testing by using chi-square generally showed that: there was a significant relationship between provisions of guidelines under procurement legislations and procurement performance in public institutions. The recommendations are expected to provide insights to public institutions in the aspect of their strategies to filter in the their planning the influence of determinants of delays in their undertaking within the institutional setup and for the PPA to work on determinants affecting the institutional performance towards amending the legislation to fervor the efficacy and performance in the public institutions as supposed to be, rather than being the cause of experienced delays in procurement processing of tenders.
