Abstract

This study assessed the role of procurement remedies in the effectiveness of tendering process in Tanzania the case being the Public procurement Appeal Authority. The main objective of the study was to examine the role of procurement remedies in the effectiveness of tendering process in Tanzania. Specific objectives included, to assess the impact of Legislative and Regulatory system performance to the effectiveness of the tendering process in Tanzania, to determine whether or not the effectiveness of PPAA’s framework and Management capacity ensure the effectiveness of the tendering process in Tanzania and to determine the contributions of the integrity of the public procurement system in ensuring effectiveness of the tendering process in Tanzania. The study viewed the descriptive research design as research philosophy. In collecting data, the study used interviews, questionnaires and documentary review. Data were analysed through statistical records. The findings revealed that there are enough remedies but PPAA failed to utilize them. Also, the study found out that PPAA’s framework and management capacity do not ensure the tendering process in Tanzania and there is no effective Integrity Analysis System provided by all PPAA, PPRA and CPP to ensure maximum control of integrity in these institutions. The study concluded that PPAA is not an independent instituton and there is high ratio of complaints compared to the number of staff which cause too much delegation of duties to PPRA. The other drawn conclusion is that some of its members and staff are unaware of other laws governing procurements also PPRA and CPP so not performing as they were expected to perform. Therefore, this make PPA as procurement remedies to fail to perform well as they were intended to.
