dc.description.abstractThose who have sought information on the extent to which the relationship of landlord and tenant is governed in Tanzania have invariably resorted in examining the Rent Restriction Act, 1984. For it is the most accessible source. Experience has proved, however, that the mere existence of such piece of legislation has only an educational value but does not limit problems of housing and security of tenure in particular. Many landlords, tenants and, in some cases, law enforcement officials are not less handicapped. The problem has therefore remained that despite its existence for a number of years residential tenants are still insecure and in some situations the law and indeed the law enforcement bodies have failed to address the societal needs of a day. This study is attempting to invoke some new insights into the law by examining the rent law itself and in addition the new Land Act, 1999 which has impacted into the law of landlord and tenant in Tanzania. I have sought also to make a comparative analysis to what is obtained in England where the Tanzanian law owes its root. What is argued in this study is that the relations between the owner of land and the tenant thereof are a matter dependant almost as much upon public than upon private law. In this sense any purposeful rent control legislation and its application must ensure equitable tenure relations.en_US
