Land reform and women’s land rights in Tanzania: A case of Moshi rural district: Kilimanjaro region

In the last two decades the issues of women’s right to land has come to be a debate both internationally and in Tanzanian context. The issues of suppression of women are increasingly becoming the concern of the national, pressure groups, legislatures and courts. The right to own land is one of the areas where women suffer suppression and oppression compared to men. Various sources indicate that, under the current legal regime access to land ownership has been embedded into customary land rights, and this has worked in favour of the male gender against the female gender, as a result very few women among many have managed to own land in full ownership. It has been argued that, women in Tanzania toil all their lives on the land that they do not own to produce what they do not control and at the end of marriage through death or divorce, they can be sent away empty handed; and that traditionally the right of women to clan land has been usufruct. That being the legal problem, the study investigates the effectiveness of women’ land rights during pre-colonial period, during colonialism, post-independence period, and after the enactment of the new land laws in Tanzania. The study basically has been divided into five chapters; one is general introduction, chapter two is the 1990’s land reform and women’s land rights in Tanzania, chapter three has discussed the limitations to women’s land rights while chapter four has presented the findings from the case study; chapter five covers conclusion and recommendations.
