dc.description.abstractThis study involves a discussion on the tenant’s security of tenure in residential rental housing in Tanzania after repeal of the Rent restriction Act, 1984. The trend shows that as urban areas grow, rental housing becomes a problem. This is attributed to rural-urban migration, as most of the migrants become renters preferable in the premises whose rents are relatively low, taking in control of consideration that most of them are job seekers. Due to the influx of migrants, housing supply fails to keep pace with the rapidly growing demand hence housing inadequacy. In situation where housing is inadequate, it is the tenants who suffer the most. Rent control has always been a resource to the suffering tenants. There has been administered in many ways one of them being rental legislation. Control by rental legislation refers to the use of law or set of laws which constrain the rent increase a landlord may change and take care of arbitrary victims. In Tanzania, several laws have been applied to control rent since colonial time. Some opinions have been that the Rent restriction Act, 1984 overprotected tenants, which over protection affected housing investment. The study attempts to show that tenants security of tenure security of tenure is occasionally important in rental housing market, as, if there is no such security to tenants, rental housing investors can not succeed. The study establishes that the new rental legislation is bias. Finally, the study suggests that the new rental legislation should create an environment in which both treatments can fairly realize their interests.en_US
