Abstract
This study is an attempt to investigate the concept "rights of the child'' in the context of International Convention on the Rights of the Child (1989) as applicable to Tanzania a state party to the Convention. Currently efforts being made to implement such rights at the U.N. and regional levels are hampered by some obstacles which inhibit effective implementation of these rights. The main purpose of this study is first, to examine the context and the contents of the rights covered in the convention. Secondly to propose the way under which Tanzania can effectively set-norms, implement and enforce the rights as covered in the convention.
The work is divided into six chapters. Chapter one introduces the historical trends with a brief survey on contextual development of the concept "rights of the child". The significance of the study is also highlighted. Chapter two discusses the rights of the Child within International Human Rights Law.
Chapter three gives a critical analysis of the U.N. Convention on the Rights of the Child within the concept of "Rights of the Child". Chapter four examines implementation and enforceability of the said rights at universal and regional levels while Chapter five reviews selected case studies in Tanzania. It addresses the mode of standard setting, implementation and enforcement mechanisms at municipal level. In the concluding Chapter six problems and limitations that are likely to hinder a successful implementation of the rights are addressed. Of remarkable importance are problems related to the weakness in the implementation machinery and the language used in prescribing the rights. This chapter also suggests possible practical solutions to the problems identified. Briefly, therefore, the underlying thesis of the study is that mere particularization of the rights of the child in a single document, does not necessarily entail the enjoyment of such rights by the child. The rights of the child should specifically address the special needs and circumstances of the child.
