Abstract
This study is an examination of the legal and institutional frameworks establishing the East African Community Monetary Union, with emphasis on the efficacy of these laws and institutions. The study is based on the fact that laws and institutions are very important components for the creation of a monetary union in the EAC. Legal and institutional frameworks are also important, not only as prerequisites for the monetary union’s establishment, but also for its operation.
The study’s major findings are that the legal and institutional frameworks establishing the EAMU are not complete and hence not effective. In spite of the EAC signing and ratifying the Monetary Union Protocol, other important laws are yet to be enacted. The Community has not set up any autonomous institution responsible for the preparatory work for establishing the monetary union. The Community has also not extended and revised the mandates of the existing institutions and organs of the Community to facilitate the establishment of a monetary union.
This study concludes by recommending that the Community should put in place all the necessary laws and institutions for the establishment of a monetary union. It further recommends that the mandates of the existing Community organs and institutions be revised and extended to facilitate establishment of the monetary union. State Parties should also harmonize their banking laws and the monetary union institutions should be given legal rights to compel Partner States to implement measures taken for establishing a monetary union.
