Abstract

This Dissertation studies widows' right to inherit property under customary and Islamic intestate succession. The work focuses on whether or not a widow has any right to inherit clan land, it being the basis of livelihood in rural areas. The study is divided into four chapters. Chapter one lays out the theoretical perspective. It provides for the background to the research problem, statement of the problem, the hypothesis as well as the methodology and the literature review. Chapter two talks of the relationship between rules of inheritance and ownership of property in society. This chapter discusses on how family as an institution and private property emerged in the society and the relationship between the two. Whereas chapter three discusses intestate customary succession in Tanzania mainland, chapter for is on widows' right to inherit property under Islamic law. Both findings of the study and our own recommendations are in the final analysis, found in the conclusion.
