Abstract

This study deals with all laws relating to the concept of likeness of products and use of almost similar/identical trade names, trade and service marks: a critical analysis of importation of substandard /counterfeit goods and services to developing counties The case study of Tanzania. In the proposal I made study on 'Theoretical Background Information to the Problem, Statement of the Problem, Objectives and Significance of the Study, Hypotheses, Research Methodology (Library Research and Field Research), and Scope of the Study, Literature Review and Chapterization The main purpose of this study is to analyze critically the law and practice relating to the problem and unveil some dilemmas surrounding this area of the law. Several issues were framed one being whether the existing laws had failed to curb the problem of importation of substandard and counterfeit goods and services to the country despite the expectation of the society and many Tanzanians that proper enforcement of the law will reduce the problem among others. The main argument advanced in the study is that the problem is caused by the implementation of the law. A critical study of the international instruments and municipal laws on trademarks, counterfeit goods and services was made. A study of case laws on trademarks, counterfeit trademarks, goods and services, both in Tanzania and in other jurisdictions was also made. The field/research findings are analyzed and discussed.
