Abstract
This is a study on Tanzania labour policy and laws as they relate to the EAC Common Market Protocol. The National Employment Policy of 2008, labour laws and other related legislation are not in harmony with the Protocol. They are discriminatory and restrictive, besides infringing the right to free movement of workers. The policy and laws are inward looking. Foreigners are employed temporarily to fill gaps on skills and technology and local experts must be produced to take over the position which is contrary to the spirit of the Protocol. Harmonization is vital to remove the inconsistency hence facilitate the enjoyment of the right to free movement of workers without discrimination. Harmonisation is a Treaty and Protocol requirement. Frameworks and processes for harmonisation at the EAC and national level are well defined. However, harmonisation of Tanzania labour policy and laws involves many stakeholders inevitably consume time and resources. Research finding reveals that, Tanzania has not harmonised its labour policy and laws. The Ministry of Labour and Employment has prioritized an internal harmonisation of labour laws and related legislation which has frustrated the harmonization process. Delayed harmonisation subjects’ workers from other Partner States to continue being discriminated under the restrictive and discriminatory labour policy and laws. The country as well will not experience the social and economic benefits of labour migration. However, it is early to conclude that Tanzania has failed to fulfil the obligation as it has committed to fully implement the Protocol by 2015. Challenges exist in the harmonisation process; recommendations are put forward to remove barriers on the process.
