dc.description.abstractThis dissertation traverses through the theory of Social Contract, especially on the principle that the theory provides on the formation of government and preservation of human rights by such governments. The study examines how the social contract theory is being reflected in Tanzania, mainly on the formation of the nation of Tanzania and on the preservation of human right by the government of Tanzania. In order to get the relevant information in construction of this dissertation, we used two research techniques being documentary review and field research. In documentary review materials were availed from Bill Supplements, Legislation, government papers and drafts, speeches, policy documents, Hansards, circulars, newspaper, and magazines, textbooks, dissertation, theses, journals, articles, reports, papers, and case law. In field research the tools employed were direct interviews, questionnaires and observation of court decisions. The research conducted revealed that the record of Human Rights preservation by the government of Tanzania has never been pleasant. Through its agencies like police and prisons, laws and administrative actions the government has taken the lead in Human Rights violations. Among the rights violated as the right of the citizens to participate in the affairs of their nation especially in law making. From the foregoing findings we have recommended for change of laws, policies and attitude towards Human Rights violations. These recommendations have been made to the Executive, the Parliament, the Judiciary, State organs and Human Rights NGOs.en_US
