    Assessment of factors causing non-compliance to public procurement act number.21 of 2004: the case of selected Public procuring Entities in Dar es Salaam Tanzania

    This study was on assessment of factors causing non-compliance to Public Procurement Act Number. 21 of 2004. Specific objectives included to identify factors making procuring entities in Tanzania not to comply with the Public Procurement Act of 2004 and its regulations of 2005; to evaluate the relationship between non-compliance to the Act together achieving with organizational goals ; and to identify strategies to enhance procurement entities comply readily with the said Act. The study used both quantitative and qualitative research approach and case study strategy. This study used triangulation in data collection methods, with selected twenty procuring entities and involved one hundred respondents. Descriptive and correlation analysis were used in data analysis. Results from the study revealed that most procuring entities did not comply with to PPA No. 21 of 2004 and its regulations of 2005 mainly due to reasons beyond their control such as, lack of fund, bureaucracy, and lack of ethical conduct. Generally, results from research and development management clustered around three in the likert scale suggesting that compliance to Public procurement Act of 2004 and regulations is generally low. In conclusion, the study reveals low level of compliance by procuring entities its recommends that the most important way to improve compliance with the Public Procurement Act of 2004 is to insulate routine procurement decisions from political interference or at least, reduce it to a minimum.
