    The legal protection of the health rights for persons with disabilities in Tanzania

    Health is one of the components of an adequate standard of living. Historically the protection of public health has been accompanied by legal regulation. The development of health law democrats that the rate of an individual`s health is often determined by factors beyond a person`s medical condition. The right to health is now universarally accepted. Despite cause -effect relationship between health and disabilities, person with disabilities encounter difficulties in accessing the right. Tanzania is a signatory of various International treaties and declaration protecting the right to health and those of persons with disabilities, and also in place laws and policies providing for health and disabilities matter. This work evaluates the state of legal protection accorded to health rights for persons with disabilities in Tanzania, taking into consideration development in International Human Rights law. The study is largely comprised of information obtained from the use of both library research and field research. Primary documentary sources like pieces of legislation, Bills Government papers, policies and decision of courts and tribunals were reviewed. Field research was carried out in Dar es Salaam, through Interviews and questionnaires. The study reveals that health and disability laws and policies in Tanzania do not accord enough protection of health rights of persons with disabilities. Considering development in International Human Rights Law, a number of administrative and legislative measure are outlined towards the promotion and protection of health rights for persons with disabilities.
