    Promoting rule of law in the republic of South Sudan: analysing the challenges to the right to life

    The dissertation investigates the violation of rule of law, particularly the right to life from the time the internal conflict of South Sudan started in December 2013 up to the time the peace agreement was signed in August 2015. It explores the challenges facing the promotion and protection of rule of law and the right to life during the internal conflict and the ways of addressing the violations of rule of law and the right to life. The current study shows that the internal conflict led to extra judicial killings which led to depopulation in the country and economic break down which has affected life sustainability. The justice system of South Sudan is characterized by incompetent judicial officers and weak institutions. The Agreement on the Resolution of the Crisis in South Sudan of 2015 under its Chapter Five provides for the implementation of transitional justice and accountability for the violations of the rule of law and human rights by the Transitional Government of National Unity. The study indicates that the government has not yet addressed the rule of law and human rights violations because of; inter alia, lack of funds and political will. In order to promote and protect rule of law and right to life in particular in the country, it is recommended that the South Sudanese government should lobby for funds for implementing the transitional justice and accountability. It should also grant conditional amnesty to the perpetrators on condition that they are willing to tell the truth so that there can be conducive atmosphere for addressing the rule of law and right to life violations.
