    Adherence of the health and safety legislation at workplaces: the case of Tanzania electrical, mechanical and electronic services agency

    The construction industry in Tanzania is ranked high in the comparative list of accident rate in the different industries, after mining and quarrying. Due to this fact, the government of Tanzania supports Health and Safety at workplaces by various means such as enacting Acts, establishing regulatory bodies, authorities and entrusting them with required powers for enforcements. Literature review, questionnaires, unstructured interviews and observations were used to test the formulated hypothesis stating that: the non-compliance to health and safety matters at the construction sites is exacerbated by the slackness of the institutions entrusted to institute the legislation. The emphases have been put on situations as found at construction/garages sites in comparison with what is in legislation and how regulatory bodies and consultants concerned are implementing their duties and responsibilities to ensure the adherence of legislation requirements. It was found that most of legislative requirements are violated or not clearly understood by stakeholders. This was found to be due to measures as stipulated in the Occupation Health and Safety Act, not yet being put into effect by the enforcement authorities. Recommendations have been made to the Government, regulatory bodies, consultants and employees/contractors to work hand to rescue the situation.
