    Speedy disposal of commercial cases in Tanzania: a case study of high court commercial division

    The purpose of this dissertation is to find out and understand the original situation, condition and cultural ties of the speed disposal of commercial cases in Tanzania by exploring, identifying and studying specific objectives particularly the adjudication of business disputes between parties at a just, effective, efficiency, purposes, and expertise and speedy pace. The study also has revealed other commercial disputes accordance with some experience, knowledge and some useful mechanisms. On the other hand the study establish some focus on the shortfalls in courts as far as performing their intended purposes as concerned with aim of understanding and drawing up a practical approach for cases resolution implementation without affecting the preservation of what is so called independency of judiciary. Consequently, the dissertation does not only pose to give specific recommendations but also attempts to reveal some ideas of the prior experts in reflection to the current situation in Tanzania. The submission also has addressed the some of resource available which can be used as efficient tool in handling of commercial cases and other relevant pressing matters. More so, researcher has tried to address application of modern designed techniques suitable for modern low court fees cost and suitability ways which can provide more consistency and predictability to litigants and lawyers. Instead of having numerous experts making unpredictable and inconsistent rulings that there are should be judges specialising in commercial cases of which can bring stability to an uncertain environment in mainland Tanzania.
