    Legal implications of information and communication technology to privacy and freedom of information in Tanzania mainland and Kenya

    The rapid development in Information and Communication Technologies (ICTs) has brought challenges on security and privacy under the cyberspace. The right to privacy and the right to information are both essential human rights in the modern information society. This thesis has analyzed the legal frameworks that regulate cyber security issues such as data protection, privacy, transmission of illegal content online and how to regulate content on the Internet in Tanzania Mainland in comparison with Kenya. The study has also examined and analyzed on how the laws and the constitution balance the competing interest between right to access information and right to privacy under online. The study adopted the qualitative approach and literature review for collection of primary and secondary data. The study has observed that privacy is increasingly being challenged by new technologies, networks and practices under cyberspace while the laws are not adequate. While cybercriminals are one or more steps ahead of law making, enforcement of laws to regulate cyberspace creates challenges in addressing privacy and balancing right to access information and right to privacy. The study recommends for enactment of effective legal framework that addresses challenges and all issues related to cyber security especially data protection online, privacy online and balancing right to access information and right to privacy on Internet.
