    The state of implementation of the East African community protocol on the customs union by Kenya and Tanzania

    This is an analysis of ratification and treaty implementation by Kenya and by Tanzania, with emphasis on the domestication and enforcement of the Protocol on the Establishment of East African Customs Union. The study is premised on the fact that implementation of the Protocol is an important component of the envisaged integration process, in fact, a precursor to all the subsequent integration phases. The major findings of the study are that despite ratifications, and other implementation measures, Non-tariff barriers (NTBs) such us weigh bridges, roadblocks unwarranted inspections and prohibitive standards which inhibit free flow of goods within the Customs Union are quite prevalent. These are coupled with Partner States’ pursuit of individual and narrow interests at the expense of the Community objectives. This study concludes by recommending that the harmonization of the EAC, SADC, COMESA and ECCAS trade regimes should be undertaken to mitigate the challenges resulting from multiple memberships. Partner States should also allocate more resources towards the removal of NTBs. Moreover, the study recommends the expansion of EACJ’s jurisdiction in order for it to take a more proactive role in the implementing the Protocol on the Establishment of the East African Customs Union.
