    The impact of foreign direct and local investment on the rights of the indigenous people: the case of land rights of Maasai in Tanzania.

    This study investigates the impact of foreign and local the impact of foreign direct and local investment to the rights of indigenous people: the case of land rights of the Maasai in Tanzania. The main objective is to exam to what extent investment has affected the rights to own and live in the ancestral land have impacted on the Maasai tribe whose life mainly depends on land. A review of some settlement and resettlement activities which were engineered by the government and private investors have been reviewed for example court cases and other activities generally whose been conducted in the name of investment and yet having bad impact on Maasai land rights, thus violation of their human rights as indigenous group. Review of various scenarios of investment activities that have affected the indigenous people have been made considering court cases and other investment activities that have raised alarm and concern on the indigenous peoples in Tanzania. Findings reveals from the cases visited, various literatures and interviews that investment have impacted negatively on the indigenous peoples since in the name of investment this group of people have been deprived of their very important right affecting their survival through resettlement, relocation and at some instances forcefully evictions from their ancestral land. The study has recommended that States should come up with special measures to address the rights of indigenous people and to recognize the existence of indigenous use, occupancy and ownership: accord appropriate legal status, juridical capacity and other legal rights in connection with indigenous peoples' ownership of land; full involvement of the Indigenous people in policy and law making ad specifically such laws which have impacts on their life and survival; State to incorporate rights enshrined in the Declaration of Indigenous Peoples Rights into its laws so as to recognize such rights as a matter of law; and that the government should create enabling environment to ensure peaceful enjoyment of land rights by these indigenous minority groups in Tanzania
