    The digital economy: legal aspects of the east african community with a focus on ict law and policy in Uganda

    This research is an exposition of law and technology with a focus on the digital economy within the East African Community. Article 103 of the Treaty for the Establishment of the East African Community provides for science and technology as an area of co-operation and recognizes its fundamental importance in economic development. The field of ICT law and policy is taken as a core aspect of science and technology necessary to drive the digital economy in the Community basing on the hypothesis that the minimal technology-centred law and policy contributes to the slow and delayed realisation of the Community’s goals and plans. Uganda is taken as a case study of how cyber laws and policies have been made to reflect the level of harmonization with the East African Cyber Laws Framework Phase I. A comparison and examination of existing international instruments is undertaken. Embedded is the idea that regional integration is one of the concepts in which the use of technology can boost economic development using law as a central point on which processes can be shaped in order to attain the Community’s integration objectives.The major finding is that the area of ICT law and policy is modern and currently emerging and evolving rapidly both globally and regionally. This research recommends mainly that all Partner States should enact and implement legislation in line with the East African Cyber Laws Framework and that the Community should focus on science and technology as a core area of cooperation to drive economic development in the Community.
