    The legal right to the highest attainable standard of mental and physical health: an assessment of the impact of Laws on public Health Financing Mechanisms on the right to health

    The right to the highest attainable standard of health is a human right recognized in almost all human rights instrument, most of which Tanzania is a patty. The Constitution of the United Republic of Tanzania, 1977 recognizes the right to health, although it places it under what ate called Fundamental Objectives and Directive Principles of State Policy which, according to Article 7 are binding, on the state towards its policies but prohibited from enforcement in any court of law. The right to health operates within the context of a country's health system which provides the framework within which the right to health can be realized, and in turn the rights to health principles help to strengthen the building up of a good health system. Financing is one of the fundamental building blocks of health systems. Tanzania 1993, introduced cost sharing policy in social service, including, health service, which were previously available for free. In order to provide financial security the Government enacted laws for implementing social security schemes into which contributions are made by members for their common benefit, This research looks at the impact of the laws that mandate the operation of these schemes and examine the operation of these scheme and examine their impact on the right to health. My findings are that the schemes that have been established, such as the National Health Insurance Fund, the Social Health Insurance Benefit, and the Community Health Fund are regressive and do not take into account fair financing principles envisaged under the right to health in human rights law.
