    The effectiveness of safety laws in Tanzania: a case of Tanga cement factory (TCF)

    The main objective of this study was to assess the compliance gap in tender processing and execution of contract in Tanzania Agencies and Local Authorities in order to be able to enhance capacity building by improving procurement process to realize the value for money. The study specifically addresses the compliance criteria in the procurement proceedings in all stages of tender processing and contract execution by ascertaining the causes of the existence gap in the identified Non-compliant Institutions. The study involved 15 respondents Public Institutions, of which 11 of them were drawn from Government Agencies/Public sectors and 4 respondents Institutions were Local Authorities. All respondents are regarded as Public Procuring Entities a as far as procurement in Tanzania is concern. This study used random sampling to obtain the above mentioned respondents Institutions from the total Public Institutions in Tanzania. Questionnaires were adopted as the main tool of collecting primary data. Case study from Procuring entities and reports from Procurement Audit Consultants were used as a secondary data to supplement the study. Then, eventually the descriptive analysis was used to obtain statistical relationships. Findings under this study have revealed that Procurement Gap in Tender Processing and Contract Executions, are caused by more than 20 reasons such as inappropriate use of method of procurement, exceptions on independence of power and functions of Accounting Officer, override of Tender Board and Procurement Management Unit duties, abnormal time for preparations of bids and advertisement of bids opportunities sometime are done on notice boards without using the widely circulating public newspapers, lack of fully fledged Procurement Management Units (PMUs), just to mention a few which may result into inefficiency, ineffectiveness and un economical use of public fund. The study, recommended in all Non-compliant Institutions to comply with the Public Procurement Act 2004 and its Regulations of 2005. Conclusively, this study confines itself on assessment by using mainly descriptive analysis which sought to explore how each assessment criteria of compliance shows to the Non-compliant Institutions to have a gap in procurement by sharing the experience in the responded Public Institutions.
