Item Protection of commercial motor vehicle policyholders in Tanzania mainland, law and practice: a case study of the commercial passenger motor vehicle policyholders(University of Dar es Salaam, 2009) Francis, Momburi DaudiLiberalization of insurance business was, among other things, expected to improve insurance business including the process of settlement of valid insurance claims. In pursuance of the above said objective, the Insurance Act, [CAP 394 R. E. 2002] categorically makes provisions which, among other things, prescribe a 60 days time limit after admission of a claim, for insurance companies to settle the said claim or otherwise seek extension of time from the Commissioner of Insurance. The above state of affairs has not, for ten years following liberalization, given the intended positive results to the commercial passenger motor vehicle policyholders owing to practical problems due to having in place an ineffective motor insurance regime. Unlike Kenya and the United Kingdom, where commercial motor makes a great deal of contribution in the growth of the general insurance business, poor road safety management systems and fraudulent insurance claims also have made it impossible for Tanzania to achieve the said objective. In the above context, this research makes a detailed examination of commercial passenger motor vehicle insurance business. Also it appraises the Motor Vehicles Insurance Act, [CAP 169 R. E. 2002] and Insurance Act, (supra). Furthermore, it provide the experience gathered from select insurance companies, select countries and selected commercial passenger motor vehicle policyholders. In so doing, this study explores possibilities to enable commercial passenger motor vehicle insurance to make notable contribution in the general insurance business portfolio.
